NameJet.com, can Pool.com not complying with spam rules

One of the reasons I think people are quick to jump on the "Domaining is shady" train is irresponsible because much of the time in our industry people behave. The large SnapNames Halvarez shill offer disaster showed that there is still a huge lack of transparency and good governance in our industry - itself whenever the big players section. This participates as if we will treat this as a game, an industry in its infancy - yet although people domaining for almost 20 years now have been.

This mention lack of responsible management brings me to the point of this Post.Ich NameJet.com and Pool.com think (and maybe others in our industry, not known me) not are CAN-SPAM Act of 2003 correspond to.

CAN-SPAM Act of 2003 (controlling the solicited pornography and Marketing Act of 2003) came on 1 January 2004 in force and "set the rules for commercial e-Mail established requirements for advertising messages receiver gave the right, you stop, you have mail, and severe penalties for infringements".

How NameJet.com and Pool.com are not correspond, the can spam Act?

Both the NameJet.com and the Pool.com are their domain list subscribers send emails that are not in accordance with the rules defined in the CAN-SPAM Act of 2003.(Are able Pool.com's daily "to delete domains Hotlist" subscribe and NameJet.com's daily "Top 50 domains delete" to receive daily email updates).

Under the can-spam rules, as defined in 15 u.s.c. 7701, et seq, the FTC the CAN-SPAM Act clarified: A compliance guide for business under other rules needed any commercial e-Mail that is an enterprise, meet the following criteria:

1. Tell recipients where you are.Your message must include your valid physical postal address. This can be your current address, a mailbox that you have registered with the US postal service or private mailbox, the you used mail rules signed with a commercial mail receiving Agency.

Pool.com nor SnapNames.com specify their physical address, mailbox or private mailbox info in the email to send to your subscribers on a daily basis.

2. Tell recipients as you any future email you erhalten.Ihre message needs a clear and conspicuous statement of how the recipient can choose from the enthalten.Handwerk of notice in a way easy for an ordinary person to recognize that receive e-Mail you in the future, read and verstehen.Kreativer can improve clarity use of type size, color and position.Enter an e-Mail address or another easy Internet-based way of their choice tell you can create a menu to a recipient must not to allow certain types of messages, but you select all commercial messages to stoppen.Achten sure that your spam filter does not block these opt-Out requirements.

NameJet.com not make or give in any how you can cancel your daily domain lists.

Although Pool.com subscriber provides your lists opt-out, are you still not in line with the changes that require that in 2008 of the CAN-SPAM Act "(1) an e-Mail recipient cannot be required to pay a fee, provide information of other than his e-Mail address and opt-Out preferences or take, others send response e-Mail message or visiting a single Internet Web page, that decide the future E-mail from a sender; be".

Pool.com specifies to the bottom of the Hotlist email sends, you can "login to your Pool.com account, click"Settings"tab and and disable your HOTLIST email setting.", but this is of course no "Single Internet Web page, to decide the future E-mail from a sender,".

Now some may argue that the daily email NameJet.com and Pool.com send not are commercial and therefore "Not false or misleading routing information may contain" but are otherwise exempt from most provisions of CAN-SPAM Act.

However, e-mail messages (as defined by the CAN-SPAM Act) may contain content or other commercial content, transactional or relationship.

The Act defines "that advertises or promotes a commercial product or service, including content on a Web site for any commercial purpose; operated".transactional or relationship defines content as content"that facilitates an already agreed transaction or updates to a customer about a current transaction;" commercial content as content.

Now.

In a Pool.com view Hotlist email, note a part that advertises Pool.com domain Markt.Heute listed it "top domains in the domain marketplace for Saturday, June 19, 2010.Danach shows the e-Mail HOTLIST stating" If you find a domain in the list should be deleting domains top; place your backorder before 19: 00 GMT (2: 00 pm EST) on Wednesday, June 16, presented "draw the reader back to the Pool.com Website.Und after the HOTLIST, the email explains the following"To view the entire list of domains deleting tomorrow you http://www.pool.com/viewlist.aspx and search engines for the keywords you are looking to go to.""

This e-Mail is clear commercial and non-transactional.

Equally so the name Jet top 50 e-Mail begins with something like this "to backorder a domain name on this list, simply copy and paste it into the search box to find it and then backorder es.Sie can also use the function" quick backorder "on your name Jet dashboard or"Bulk add"feature of my orders use."

Then it goes on the back of the reader to the list of domains prior to drawing the name Jet website "sure visit also http://www.namejet.com/Pages/Auctions/PreRelease.aspx?cat be"
